Privy Council dismisses appeal concerning the construction of a Mauritian employment contract, confirming that payment of a contractual 13th-month payment validly discharged the employer’s obligation to pay a statutory end of the year gratuity. The Appellant’s claim that the contract was designed to avoid the need to pay him this gratuity, that this sum remained outstanding, and that he was entitled in consequence to consider himself constructively dismissed, was rejected by the Board. The case provides a helpful restatement of the key principles adopted by the Courts when construing contracts governed by Mauritius law.
