The case is on appeal from the Court of Appeal. The issue is whether the ban contained in paragraph 277 of the Immigration Rules on the entry for settlement of foreign spouses between the ages of 18 and 21 is a lawful way of dealing with the problem of forced marriages? As part of the Government’s policy to combat forced marriages, paragraph 277 of the Immigration Rules was amended with effect from 27 November 2008 to raise the minimum age for a person to be granted a visa for the purposes of settling in the United Kingdom as a spouse, and for sponsoring another for the purposes of obtaining such a visa, from 18 to 21.
