The vexed question of the temporal scope of Rome II (aka EC Regulation 864/2008 on the Law Applicable to Non-Contractual Obligations) has been referred to the European Court for determination. The reference has been made in a case involving a road traffic accident in France where the issue is whether English or French law applies to the quantification of damages.
