There are many advantages to mediation over court proceedings, in particular mediation is confidential, ‘without prejudice’ and can be arranged and concluded very quickly.
Mediation is effective in most cases where the parties are committed to finding a resolution. Mediation can avoid significant costs for all parties, reduces the emotional burden of litigation, and reduces the risks associated with going to court. When a settlement is reached through mediation it is the product of negotiation, over which the parties retain control and into which they have had input, rather than a court-imposed decision that may leave both sides dissatisfied. More creative and practical outcomes can be achieved by way of mediation which the courts do not have the power to order. Additionally, mediation can help preserve business and personal relationships that might otherwise be damaged by the adversarial nature of litigation.
