Peter Knox QC and Richard Samuel who acted for the intervener (the All Party Parliamentary Group on Fair Business Banking) in Marex, will be discussing the Supreme Court’s decision, which has overturned 20 years of law on the so-called rule against reflective loss. The talk will include a summary and analysis of the judgment, its impact on shareholders, creditors, and liquidators, and the likely future ‘battle grounds’ on the subject of reflective loss.
