The case involved a challenge to the Secretary of State’s decision that the claimant was not a victim of trafficking and whether the Secretary of State was out of time to return the claimant to Norway under the terms of the Dublin II Regulation. The Court held that where a person has been a victim of trafficking it does not matter whether they were trafficked into the UK for them to be afforded victim status under the Trafficking Convention.
