When considering whether Regulation 44/2001 art.9(1)(b) and 11(2) applied to allow a passenger injured in a road traffic accident in France to pursue proceedings in England directly against the responsible party's French insurer, the applicable national law to be considered was the law governing the insurance contract and not the law of the court determining the dispute.
