Summary: A claim made by a company in which the central issue was whether a flat and a car had been gifted to the defendant by the company’s director was entirely unsuitable for summary determination. The defendant had an arguable case, with a real prospect of success, that the director and the company had intended her to have beneficial and legal ownership of the property.
