In breach of the European Convention on Human Rights 1950 art.5(4) the Parole Board had caused delays in its decision-making in respect of the release on licence of a prisoner held for public protection whose tariff had expired. There was no explanation for those delays, so it was to be inferred that they had been caused by a lack of resources or error or omission, and he would be entitled to compensation.
