The tribunal followed the decision in Gilbert v Barnsley MBC and held that in assessing the redundancy entitlement of a further education college employee who worked only during term time and had to take her statutory holiday entitlement outside term time, "a week's pay", for the purposes of the Employment Rights Act 1996 s.221, had to be calculated by dividing her annual salary by the number of weeks she worked, including her holiday entitlement.
