Introduction
By an application notice dated 2 November 2020 the Defendant seeks an order granting summary judgment pursuant to CPR 24.2. The underlying claim is one of alleged professional negligence by the Defendant law firm. The Claimant is a corporation domiciled in the British Virgin Islands. It brings the claim as purported assignee of the Defendant’s former client Paul Baxendale-Walker. The application was supported by two witness statements from Jonathan Sachs. The Claimant relied on a witness statement from Neil Kelley.
