Case summary

Issue

The main issues are: (i) whether the Court of Appeal wrongly considered only two out of Bastian’s twelve grounds of appeal; (ii) whether the evidence was sufficient to convict Bastian; and (iii) whether Bastian was prejudiced by a joint trial, which presented the jury with evidence which was not admissible against him.

Facts

On 12 May 2013, Anton Bastian and two other men, Craig Johnson and Marcellus Williams, robbed two women of their purses at a restaurant. A bystander intervened. A struggle ensured between the bystander and Johnson while Bastian and Williams fled the scene. Johnson shot and fatally injured the bystander.

All three men were arrested and charged. On 3 November 2015 they were found guilty of one count of murder and two counts of armed robbery. They were each sentenced to forty years’ imprisonment. All three appealed their convictions and their sentences to the Court of Appeal. Their appeals were dismissed. Anton Bastian now appeals to the JCPC.
