Tabitha has a busy practice across all of Chambers’ core areas. She has a particular interest in commercial, public, employment, personal injury and travel law matters. Much of her work has an international dimension.

Tabitha appears in Court on a very regular basis for trials and applications, alongside her written practice.

Before joining Chambers, Tabitha Hutchison spent a year as Judicial Assistant to Lord Justice Dingemans in the Court of Appeal, where she worked on significant public law cases such as R (Cabinet Office) v Chair of the UK Covid-19 Inquiry and Ors [2023] EWHC 1702 (Admin) and R (Good Law Project) v Prime Minister and ors [2022] EWCA Civ 1580.

Before that, she spent three years in New Delhi, working in human rights and education.

Pro bono work remains a priority in Tabitha’s practice.

Expertise

Tabitha accepts instructions across all aspects of commercial, company and insolvency litigation and advisory work, including in winding up and bankruptcy proceedings.

Tabitha has a keen interest in employment law. She recently acted for the successful Respondent in the 4-day trial of a claim for disability discrimination under sections 13 and 15 of the Equality Act 2010. The Respondent’s case was that the Claimant had been dismissed, not because of his disability, but due to his unsuitability for the role, including his alleged assault on a colleague.

Tabitha has previously undertaken employment law training with the Free Representation Unit and assisted with drafting the sex and maternity discrimination chapters of Tolley’s Employment Handbook.

Tabitha has experience of a broad range of landlord and tenant work, including claims for possession, housing disrepair or other residential and commercial lease disputes. She recently acted in the 2-day trial of an application under Section 14 of the Trusts of Land and Appointment of Trustees Act 1996, during which she cross-examined three factual witnesses. Tabitha’s client was successful in obtaining an order for sale.

Tabitha is a member of the Attorney General’s Junior Junior Scheme. She has been instructed in matters relating to immigration, as well as assisting senior members of Chambers with judicial review matters, including those engaging questions of human rights, and with appeals to the Judicial Committee of the Privy Council.

Tabitha also undertakes pro bono work in this area, particularly in relation to cases arising out of the Commonwealth Caribbean.

Before coming to Chambers, Tabitha assisted a barrister working on the Grenfell Tower Inquiry, with a particular focus on issues relating to disability and personal emergency evacuation plans. She was closely involved in drafting closing submissions for the final phase of the inquiry.

As well as her domestic personal injury work, Tabitha is instructed in a broad range of matters involving the Package Travel Regulations 2018, the Montreal Convention and EC Regulation 261/2004. She also has experience of CEDR adjudication work.

Tabitha is very frequently in Court dealing with trials, interim applications and case management conferences. She also has a busy paper-based practice, drafting pleadings as well as advice on liability, causation, quantum, evidence and costs.

By way of example, Tabitha has previously acted for tour operators in relation to the cancellation of school trips during the COVID-19 pandemic, and in contractual claims for loss of enjoyment, one of which was reported widely in the media for the Claimants’ complaint of “stale croissants”.

During pupillage, Tabitha assisted Katherine Deal KC and other supervisors in a broad range of high-value personal injury matters. In the aviation context, she assisted Chris Loxton in the case of Lunn v Antarctic Logistics Centre International (Pty) Ltd (No. 2) [2024] EWHC 169 (KB), in respect of severe injuries the Claimant sustained on an airbase in Antarctica, and in the jurisdictional dispute surrounding Zephyrus Capital Aviation Partners 1D Ltd & Ors v Fidelis Underwriting Ltd & Ors (Re Russian Aircraft Operator Policy Claims (Jurisdiction Applications)) [2024] EWHC 734 (Comm), for several lessors in proceedings against reinsurers concerning the loss of aircraft and engines detained in Russia.
