Emily acts in a wide range of civil and commercial matters with a particular focus on international and cross-border work.

Emily has appeared as sole counsel in the High Court and junior counsel in the Court of Appeal. She is currently developing her experience in international arbitration.

Emily is developing a broad practice covering all areas of commercial and business law, including contractual disputes of all types, insolvency and company disputes. She has a particular interest in civil fraud.

 

Notable Commercial, Insolvency and Civil Fraud cases


Group Seven & Ors v Notable Services LLP & Ors [2019] EWCA Civ 614

Junior counsel (led by Aidan Casey QC) in a four-day Court of Appeal hearing representing the employee of a bank in his appeal against findings of liability for dishonest assistance associated with a €100m fraud.


Currently instructed as second junior counsel (led by Simon Davenport QC and Tom Poole) in a LCIA arbitration concerning a copper mine in Russia, with substantial Russian law elements and offshore issues.


Assisted Aidan Casey QC in another series of international arbitrations arising out of Russian / CIS disputes, including advising on anti-suit injunctions and associated issues.


Regular appearances in the Business and Property Courts and the County Court in a range of corporate and personal insolvency matters and general commercial claims.


Emily has a keen interest in employment issues and is beginning to develop her experience appearing in the Employment Tribunal. Her recent experience includes acting for the Respondent in a constructive dismissal claim involving allegations of breach of the implied duty of trust and confidence. She has also advised on employment law issues in Caribbean jurisdictions.

Emily has a keen interest in public, administrative and constitutional law. She has represented detained clients pro bono through Bail for Immigration Detainees. During her pupillage in 2016, she worked on a constitutional appeal to the Privy Council from Saint Lucia concerning the right to silence in the context of criminal trials.

Emily is regularly instructed in cross-border claims involving issues of jurisdiction and conflict of laws. In travel law, Emily has substantial experience acting for a number of well-known tour-operators and airlines in a range of claims under the Package Travel Regulations, the Montreal Convention and the Denied Boarding Regulations. Emily has also acted as junior counsel in appeals before the Privy Council.

 

Notable Travel and Aviation cases


University of Technology, Mauritius v Gopeechand [2018] UKPC 26

Successfully acted for the Respondent (led by Katherine Deal QC) on a pro bono basis in an appeal from Mauritius concerning an employer’s liability for injuries sustained by an employee during a road traffic accident on their journey home from work.


Ramsook v Crossley [2018] UKPC 9

Acted pro bono as amicus curiae (led by Thomas Roe QC) in an appeal from Trinidad and Tobago concerning the construction of a driver’s insurance policy.


Acting and advising in a range of aviation matters, including claims for discrimination against airlines.


Advising on and drafting jurisdictional applications.


Emily is able to accept instructions directly from members of the public, companies and other entities through the public access scheme (also known as direct access).  She is able to advise and draft pleadings and documents for individuals and small and medium sized businesses on a direct access basis.
