Claire Errington’s practice focuses on commercial, public, sport, travel and personal injury law, with both domestic and international elements.

Claire joined 3 Hare Court as a tenant in October 2022 following the successful completion of her pupillage in chambers. Claire gained experience across all of Chambers’ core practice areas during pupillage. She regularly appears in trials, preliminary hearings and interim applications in the County Court, as well as undertaking a variety of paperwork across chambers’ practice areas.

Prior to pupillage and throughout her policy work at the United Nations Department of Peace Operations and elsewhere in New York, Nairobi and Cape Town, Claire gained exposure to many jurisdictions and legal systems. Her work and research have seen her interviewing leading International Criminal Court prosecutors at The Hague, as well as acting as legal representative of refugees in South Africa in matters ranging from property disputes to employment issues.

Claire has undertaken a variety of pro bono legal work, including acting as Project Leader of Durham University’s Lawyers Without Borders and Syrian Legal Development Programmes, whereby she worked on a variety of projects and cases to promote access to justice and the rule of law across the world.

Expertise

Claire accepts instructions in various matters of public law and inquiry work, having a keen interest in these areas of practice. She is currently instructed on the Post Office Inquiry, which aims to examine the implementation and failings of the Horizon IT system at the Post Office over its lifetime. Claire is also instructed on behalf of the Designated Lawyers Team on the Undercover Policing Inquiry, which seeks to investigate undercover police operations and practices between 1968 and 2008 in England.

Claire is also currently instructed by the Attorney General in Jersey in relation to proceedings in the Royal Court of Justice, which has included a large disclosure and redaction exercise. She has also:

  • Been led by Thomas Roe KC in Judicial Review proceedings in the High Court of Justice
  • Assisted Simon Davenport KC with case law research regarding the court’s approach on deciding preliminary issues in advance of trials in the Caribbean.
  • Assisted Robert Strang with case law research relating to the interpretation of summary offences and limitation in relation to the Summary Courts Act (and related historic acts), in the matter of Chandra Silochan and another (Appellants) v Rickie Cedeno (Respondent) (Trinidad and Tobago) [2023] UKPC 5.
  • Assisted Rowan Pennington-Benton by conducting research on the interaction between statutory duties and contractual obligations in advance of an interim relief application.

Claire is developing a broad practice incorporating all aspects of company and insolvency litigation and advisory work. Claire’s work currently includes advising on insolvency applications and litigation, and she is regularly instructed to appear in winding up and bankruptcy petitions. She was most recently been instructed to advise on a insolvency application with a complex dispute in relation to COMI.

Claire has also assisted senior members of chambers in various company and insolvency matters, including drafting an injunction in relation to the future presentation of a winding up petition, and providing assistance in a matter relating to the restriction of transfers of shares in companies in articles of association and shareholders agreements.

Claire’s practice also encompasses property law matters. She has court experience representing clients in matters arising out of property defects, disrepair and repair works. She has also appeared in possession hearings flowing from bankruptcy proceedings, and provided advice on such matters.

Claire is developing a broad practice encompassing all aspects of commercial litigation and advisory work, advising on a range of general matters and drafting contracts for commercial transactions.

Claire has worked on a variety of commercial disputes, including:

  • Assisting Simon Davenport KC with research regarding pursuing a stay of proceedings in claims whereby reference has already been made to the Financial Ombudsman Service.
  • Assisting Thomas Roe KC with research in regards to drafting clauses in a purchase agreement in the coal mining industry to protect party in event of default or early termination by a buyer.
  • Assisting Asela Wijeyaratne in a matters relating to contractual interpretation, including in relation to breach of contract in loan agreements and terms in distribution contracts.

Claire has developed a busy practice in personal injury. She regularly appears in court and advises on issues arising out of road traffic accidents, accidents abroad, holiday sickness claims, occupier’s liability, the Highways Act 1980, and procedural issues in relation to the relationship between Part 7 and Part 8 proceedings. Claire is developing particular expertise in procedural matters, liability, causation, quantum, and evidential issues. She has also assisted senior members of chambers in personal injury matters, conducting research for Howard Stevens KC and James Hawkins in a dispute over the liability of a public body in relation to a Highways Act 1980 claim.

She accepts instructions on a wide array of litigation, including interim applications, costs disputes, case management conferences (CMCs) and costs and case management conferences (CCMCs) as well as drafting advices, including quantum advices for use in infant settlement approval hearings.

Claire frequently accepts instructions in a broad variety of matters involving the Package Travel Regulations (both the 1992 and 2018 iterations), appearing in court for fast track trials as well as undertaking an extensive travel and aviation paperwork practice. Her paperwork practice includes drafting pleadings and advices in matters relating to the Package Travel Regulations. She has recently advised a client on procedural processes and difficulties when claiming against the Motors Insurance Bureau.

Claire regularly represents a number of airlines in claims for breach of contract and passenger compensation claims under the Montreal Convention and Regulation (EC) No 261/2004 of the European Parliament and of the Council. Further, she also drafts pleadings on behalf of airlines for use in Centre for Effective Dispute Resolution proceedings.

Claire also publishes articles on the latest developments in travel litigation in Chambers’ Travel and Aviation Quarterly. This has included a case analysis regarding the High Court’s judgment in Lambert v Motor Insurer’s Bureau [2022] EWHC 583 (QB) with Asela Wijeyaratne. She has also written articles on other travel law matters, including an analysis of the CJEU referral on the issue of interpretation of Articles 3 and 13(1) of the Motor Insurance Directive 2009/103.

Throughout her pupillage, Claire conducted extensive research for senior members of Chambers on travel law liability and causation issues, and drafting pleadings, including

  • Assisting James Hawkins with preparation of pleadings in gastro-illness abroad claims, including an Appeal in the High Court.
  • Assisted Asela Wijeyaratne with the drafting of pleadings in a matter of negligence resulting in wrongful
  • Assisted Asela Wijeyaratne with the development of a presentation on the landmark case of X v Kuoni relating to the scope of obligations under package travel contracts.
