The claimant had not abused the process of the court by bringing a human rights claim arising from a refusal of leave to enter where he had previously raised a human rights argument in an appeal to the Asylum and Immigration Tribunal. While the AIT could determine whether the appellant's human rights had been breached, it could not order the payment of compensation or make a declaration.
