Facts

A freezing injunction was granted to a Liquidator after a long period of delay even though a criminal restraint order was in place as that order was not intended to protect the applicant and could be abandoned as no charges had been brought against the respondent and it was for the Crown Prosecution Service to decide whether it wished to maintain it; the order was granted nearly 6 year after the events in question but the court decided that the delay caused not enough prejudice to lead to the refusal of the order.
