A family that had booked an all inclusive holiday with a tour operator was awarded damages for breach of contract after contracting food poisoning during the holiday. The hotel food was the source of infection and there was an implied term under the Supply of Goods and Services Act 1982 s.4(2) that the supply of goods, which included food, would be of a satisfactory quality.
